This policy is from Customer Experience Insight Pty Ltd (ABN 61 634 039 759) trading as WA AI Hub. It forms part of our Terms of Service and should be read with our Privacy Policy.
1. If you are under 18
This service is only for people aged 18 or over. If you are younger, please don't create an account or send us your information. It was made for adults who build products and do research at work.
If you are under 18 and you have already signed up, tell a parent, carer or teacher, or email us at privacy@wahub.ai. We will close the account and delete your information. You won't be in trouble.
If something online has frightened or upset you, you can talk to Kids Helpline (1800 55 1800, free, any time) or report it to the eSafety Commissioner at esafety.gov.au/report. In an emergency, call 000.
2. Why adults only
- It isn't designed for children. Nothing in the Service is made to attract, entertain or teach children, and we don't market to them.
- Contracts. In Western Australia a person becomes an adult at 18 (Age of Majority Act 1972 (WA)). A contract with a younger person may not bind them. Our Terms and paid plans need someone who can agree to them.
- AI content. The Service uses AI to write text and make images and audio. We want to be sure that people using it are adults who can judge the output.
- Privacy. Children's information needs extra care. The safest way for us to give it is to not collect it.
3. How we keep children out
- Age confirmation. To use any feature you must confirm you are 18 or older, together with accepting our Terms, before you can generate anything. We record that you did.
- No age data. We don't ask for a date of birth, because collecting it would mean holding more personal information. This also means we can't check your age. A tick-box is not proof of age, and we don't pretend it is.
- No targeting. We don't use advertising, tracking or analytics cookies, we don't profile users, and we don't show any user content to other users.
- Reports. Parents, teachers and anyone else can tell us about a child using the Service (section 7), and we act on it.
4. If we find out a user is under 18
- We suspend the account straight away so no new information is collected.
- We close the account and delete the personal information we hold about it, including the library, within 30 days. We keep only what the law requires us to, such as payment records for tax. Those records are held securely and aren't used for anything else.
- We refund any unused part of a paid plan, in full, to the original payment method.
- We tell the parent or guardian who contacted us, if they did, what we did. We don't ask them or the child for more personal information than we need to find the account.
Parents and guardians can ask us to do this at any time at privacy@wahub.ai. To find the account we will usually only need the account email address.
5. Information about children in what you upload
The Service is built for fictional personas. Please don't upload information about real children.
- No children's personal information. Don't upload names, photos, school records, interview notes, survey answers, health information or anything else that identifies a person under 18, unless you have the lawful authority, including a parent or guardian's consent, and a real need. Even then, de-identify it first. Our Privacy Policy (section 4) explains what to leave out.
- Schools and educators. The Service is for adults. Teachers and school staff may use it, but must not enter student information.
- Research with children. If you research with children, getting consent, ethics approval and any needed legal clearance is your responsibility. We can't check it.
- Fictional young personas. You can write a persona about a typical young user of your product, such as a student, as long as it is a fictional composite and not based on a real child.
- Portraits. We always ask the image service to draw an adult, whatever age a persona states. We never intend to produce images of children. AI can make mistakes, so tell us if you see an image that looks like a child.
6. What is not allowed
You must not use the Service to create, request, store or share:
- any sexual, abusive or exploitative material involving a person under 18, including AI-generated or fictional material;
- content that grooms, bullies, stalks or harms a child, or promotes self-harm to children; or
- material that is otherwise illegal under the Online Safety Act 2021 (Cth), the Criminal Code (Cth) or the Criminal Code (WA).
If we find this, we remove it, close the account without notice, keep the evidence the law lets us keep, and report it to the eSafety Commissioner and to law enforcement, including the Australian Federal Police and WA Police, as the law requires or allows. We don't warn the person first if doing so could put a child at risk or interfere with an investigation.
7. Reporting a concern
- To us: email privacy@wahub.ai with "Child safety" in the subject. Tell us what you saw and, if you can, the account email. A person reads these within 1 business day and acts quickly.
- To the authorities: report illegal or harmful content to the eSafety Commissioner at esafety.gov.au/report. If a child is in danger now, call 000. You can also contact the WA Police Force or the Department of Communities (Child Protection) in WA.
- Don't send us the material itself. Describe it, and report it to the authorities.
8. Our privacy approach for children
- Australia. We aren't currently required to follow the Australian Privacy Principles because we are a small business, but we apply them voluntarily (Privacy Policy, introduction). The Office of the Australian Information Commissioner (OAIC) is making a Children's Online Privacy Code. As at 1 October 2026 it isn't in force. When it is registered we will review it and, where it would apply to services like ours, follow it. In the meantime we follow its main ideas: collect as little as possible, put the child's best interests first, keep notices simple, and don't profile or advertise.
- European Union and United Kingdom. The service is adults-only everywhere. Under the GDPR (Art 8) a child under 13 to 16, depending on the country, needs a parent's consent to some online services. Because we don't offer the Service to under-18s and don't rely on a child's consent, that rule isn't engaged. We still explain our approach in clear, plain language as the GDPR (Art 12) asks.
- Online safety. The Service is not a social media platform, and nothing users create is shared with other users, so Australia's social media minimum age rules don't apply to it. We follow the eSafety Commissioner's expectations for services that use generative AI.
9. Complaints
Email privacy@wahub.ai. We acknowledge a complaint within 5 business days and aim to resolve it within 30 days. You can also complain to the OAIC (oaic.gov.au) or the eSafety Commissioner (esafety.gov.au). Our privacy complaints process is in section 14 of the Privacy Policy.
10. Changes
We will update this policy when the law or the Service changes, and publish a new version and date. For significant changes we will ask existing users to review and accept it.
